There are many forms of private investigation. Images of shady characters in long over coats wearing large hats and tailing suspects through busy city streets readily come to mind but in reality, these images are best reserved for Hollywood. If you are thinking of becoming a private investigator or you are just starting out, surveillance will be an important part of your charter.

This article will endeavor to present some private investigation and surveillance tips which may help you in determining whether this is for you. The world of the private investigator is one of patience and dedication which will see you in some unusual situations.

Let's start with investigation vehicle and tailing.

For mobile surveillance it's recommended that mini-vans are preferred. Accessories such as tinted glass are an excellent smoke screen that allows you  to sit in the back, unnoticed, almost anywhere. It's also suggested that older mini-vans are better because they blend in better and are more nimble than newer ones. These type of mini-vans are a dime a dozen and don't draw attention.

More Private Investigation And Surveillance Tips - Tailing On The Move

When tailing in city streets, it's advised to stay on the suspect vehicle's bumper while in slower areas, you should allow a car between the vehicle you are following and you. The problem of conducting a tail in the city is that there are too many stoplights, traffic and stop signs. Losing your suspect can be easy.

A private investigator has to possess some detective ability as well. When determining whether a vehicle has been moved during the night check the dew on the vehicle. If it's lacking, then this is a sure sign the vehicle was moved. Staying in touch with a person when you are tailing requires a little skill but this gets better with more experience. When the vehicle you are following makes a sudden stop in front of a house, keep calm and continue on a short way and when appropriate, pull into an empty driveway but keeping the target in view at all times.

Some Verifying And Recording 101

Experienced private investigators generally follow the same process with verifying a person's address. The obvious is a name on the mailbox but if there are none, then check to see if there is mail protruding from the mailbox before taking a quick look.

Count the number of electric meters to ascertain whether the home is a multi-family or single home. Taking detailed notes via a voice recorder or pen and paper is highly recommended. If there is a vehicle in the driveway, make note of the vehicle's number plate and it's make as well as the date and time. Record anyone showing up, any vehicle movement, etc. Taking notes is important for your client’s report. Accuracy is vital because, as a private investigator, you may be asked to testify.

It is always difficult to accurately estimate the height of an individual. One tip is to compare the person's height to that of the vehicle that they get out of or into. This becomes much easier over time.

Video Surveillance Tips

For starters, make sure you have a reliable camera because of the stop start nature of this kind of surveillance. One trick is to create a border between each clip and an effective way is just placing a hand or fingers over the camera. Your camera should display a time and date stamp; today, this is almost regulation with most cameras. Don't just concentrate on close ups of the suspect; wide shots are critical in verifying that the person was actually at the location you are surveying.

Finally and this is often overlooked, toilet paper, yes, toilet paper is often a good idea. Why? Well, simply put, you will be involved in the occasional long stake out and when mother nature beckons in awkward situations, you'll be glad you have a roll of toilet paper in the vehicle.

While the above doesn't sound as glamorous a job as that portrayed by Robert Mitchum as the famous Philip Marlowe, it's not meant to be. But if you adhere to proper private investigation and surveillance tips, then your career as a private investigator should prove rewarding.

But employers must be careful not to go too far in their surveillance or they will risk being sued by an employee for an invasion of privacy under federal or state law. This article is an overview of the laws applicable to workplace surveillance - you should always talk to your own attorney to determine exactly what the law is in your state.

VIDEO SURVEILLANCE
There are several variables when considering video surveillance in your place of business. Your choices include visible traditional and dome surveillance cameras or hidden cameras, with or without audio. Each of the variables has potential legal implications. Visible surveillance cameras (not hidden in any way) are generally not illegal if they are in a non-private place.

If the camera records sound as well as video, you must comply with federal and state wiretapping and eavesdropping laws. You will need consent of one or all parties to any recorded conversation, depending on your jurisdiction.

Hidden cameras are a slightly different story. Video recording (without sound) is usually okay, even if the camera is hidden unless the person(s) being recorded has a reasonable expectation of privacy, the taping is done for some illegal purpose or there was trespass to record the video.

Courts across the country are finding with more and more frequency that no reasonable expectation of privacy exists with non-covert video surveillance or even with hidden surveillance if the physical space examined is a public space. Note that, if an employer uses union employees, the employer may be required to notify the union of its intention to use hidden cameras, but probably doesn't have to disclose where the cameras will be installed.

There is a federal law which makes it a crime to secretly capture photo or video images of people in places and situations in which they have an expectation of privacy. Most states have followed suit. These laws are often referred to as "video voyeurism" statutes.

VIDEO VOYEURISM LAWS
As you can see, surveillance technology has advanced so much over recent years that excellent cameras can be completely hidden from view in a number of different ways. These Spy Cameras are a great tool for many employers but can also be used inappropriately. The federal government and most states have recently passed "video voyeurism" laws.

These laws make it a crime to secretly record or distribute images of people in places where they have a reasonable expectation of privacy, such as bathrooms, dressing rooms, locker rooms, hotel rooms and tanning salons.

The federal law prohibits anyone from recording images of an individual's "private areas" without consent when that individual has a reasonable expectation of privacy. Every state in the U.S. now has some legal prohibition of video voyeurism or invasion of privacy, except Iowa and Washington D.C. About half of these statutes actually make this kind of video recording a felony. Many have an even harsher punishment for distributing such videos.

You will need to check your home state's particular laws as the courts from state to state may have differing opinions as to what types of places are expected to be private - bathroom and changing rooms may be "no-brainers" but some states' courts have even decided that employee break rooms or lunch rooms are "private" for purposes of video surveillance.

OTHER SURVEILLANCE IN THE WORKPLACE
The monitoring of electronic communications such as telephone calls, voicemail, email and IMs is covered by the federal wiretapping and eavesdropping statute - the Electronic Communications Privacy Act. The ECPA does include several business use exceptions to allow employers to perform necessary investigations, protect trade secrets and keep an eye on inventory and receipts.

Under the federal law, the monitoring of things such as email and phone calls is allowed if either the sender or recipient consents or if it is done in the regular course of business. Employers can monitor only equipment which they own and do not have the right to monitor email hosted by a third party (like web-based email programs.

BEST PRACTICES
Whether they have a right to privacy at work or not, many employees find surveillance of any sort offensive. It is good practice for employees to be provided with written notification of the existence or possibility of any monitoring in the workplace - video, audio or otherwise.

Notices can be made a part of a written, distributed policy or a section in the employee handbook. Employees can even be asked to sign a consent to or acknowledgement of the monitoring. If you are cautious, ethical and respectful of your employees and of the law, video and other surveillance in the workplace can be a wonderful tool to keep your business running smoothly and profitably.

To Install or not to Install Surveillance Cameras

After the infamous 9/11 event, governments and people rallied or debated for and against increased public surveillance cameras and the eye in the sky. But before this, people raised a hue and cry over the intrusion of their privacy in the workplace but the events that fateful September day thrust the issue of covert surveillance to the core of mass consciousness. Now here you are with your newly installed outdoor surveillance camera.

It's a different story when it's about your outdoor surveillance camera. You are protecting your property against thieves and vandals so people who enter the premises of your property should be subjected to surveillance, especially if no one is at home. Good try. You're on the right track because thousands of other home owners share this view. Go ahead and install your outdoor security camera.

It's legal to install that outdoor surveillance camera, but it is not always legal to rig spy cameras in guestrooms and in the bath. If you are caught at it, expect a long-drawn court battle and spending time behind bars, or a stiff fine. If you hate the thought of office spy camera watching your every move so why spy on your house guests and the nanny?

If it is necessary to have a nanny cam indoors, you have to inform the new nanny. Some States require this and failure to do so means BIG trouble.

The Bad Guys and the Good Guys

That outdoor surveillance camera does not discriminate against the good guys and the bad guys. It will keep on recording people passing by, going up your doorstep, and people leaving your home. Friends do not have to disguise their faces but expect the bad guys to don big sunglasses and hats.

When you go through the day's recordings transmitted by your outdoor surveillance camera, you can't just pick out a suspicious looking chap and show the video to the police. You have to be careful. Just because he looks suspicious does not warrant he's a thief or vandal. That's the beaut of it. Unless he is caught squeezing himself into the window and an indoor camera pans and zooms into his face, then you have your man.

The video and audio recordings in your home are admissible in court but not all the time. If you have a bone to pick with the nanny or a neighbor and you have proof of their misdeeds within your property, the recording will be their downfall in court. However, secret audio recordings of law enforcers are illegal if these are not obtained under the so called color of law.

To be safe, homeowners stick with video surveillance using their indoor or outdoor surveillance camera. Better record actions than verbal abuse or eavesdrop into private conversations. So don't risk your sanity with audio surveillance. Stick to those surveillance cameras and avoid the politics and legal implications that goes with audio interceptions.
